الأساليب الاستثنائية الحديثة لإبرام الصفقة العمومية عبر البوابة الإلكترونية "في ظل أحكام المادة 206 من المرسوم الرئاسي رقم 15/247"

Résumé: الدراسة تناولت الأساليب الاستثنائية المستحدثة لإبرام الصفقة العمومية عبر البوابة الإلكترونية، وذلك باعتبارها من أهم المستجدات القانونية التي جاء بها المرسوم الرئاسي رقم 15/247، في إطار الاستفادة من المزايا التي تتيحها تبادل المعلومات بطريقة إلكترونية لإبرام الصفقة العمومية، بدراسة المادة 206 دراسة تحليلية تمكننا من الإحاطة بكافة الأطر القانونية والموضوعية لكل من المزاد الإلكتروني العكسي والفهارس الإلكترونية. لنصل في ختامها إلى توضيح كيفية تأثير السلطة التقديرية الواسعة الممنوحة للمصلحة المتعاقدة في اختيارها للأسلوب الاستثنائي للتعاقد، على المبادئ التي تحكم الصفقة العمومية والتي قد تؤدي إلى الإخلال بمبدأ المنافسة. This study deal with the updated exceptional means of making public transactions through the electronic gateway. As it is considered as a legal development which is brought by the presidential decree No.15/274 within the framework of taking the most of the advantages of exchanging information available through the electronic gateway to make public transactions. Based on a descriptive analysis of the examination of article 206 to enable taking all the legal and subjective frameworks of the reversed electronic auction and catalogues. To conclude with clarifying the impact of the broad discretionary authority of the contractor’s interest for the exceptional contractual method, on principles which govern public transaction as it may violate the principle of competition.
