الأطر الناظمة للتدخل الإنساني في ظل محدّدات مسؤولية الحماية Frameworks For Humanitarian Intervention Under The Limits Of Responsibility For Protection

Résumé: ملخص: يعتبر مبدأ مسؤولية الحماية الدولية لحقوق الإنسان نظام دولي جديد جاء عقب الانتقادات الشديدة التي وجهت لمبدأ التدخل الإنساني، حيث تم إقرار هذا المبدأ تبعا للانتهاكات الجسيمة التي شاهدتها منظومة حقوق الإنسان في الآونة الأخيرة من جهة، وكذلك لتعاظم الاهتمام الدولي بهذه الحقوق، الأمر الذي أحدث هزة في تراتبية مبادئ القانون الدولي، وخصوصا مبدأي السيادة الوطنية، عدم التدخل في الشؤون الداخلية للدول، ويخضع هذا المبدأ إلى جملة من الشروط والمعايير والتي تدور في مجملها حول ضرورة ضبط معادلة التكامل والتوازن بين إعمال هذا المبدأ وبقية مبادئ القانون الدولي، الأمر الذي أعطى لهذا المبدأ أبعادا إنسانية وأخرى عملية جعلت منه منهجا جديدا في التعامل الدولي. Abstract: The principle of responsibility for the international protection of human rights is a new international order following the strong criticism of the principle of humanitarian intervention. This principle was adopted according to the serious violations witnessed by the human rights system in recent times, as well as the growing international interest in these rights, which caused a shock. In the hierarchy of the principles of international law, in particular the principle of national sovereignty, as well as the principle of non-interference in the internal affairs of States, this principle is subject to a set of conditions and standards, which revolves around the need to control the equation of integration and balance between the implementation of this principle and the rest of the principles This principle has given humanitarian and practical dimensions a new approach to international engagement.
