خصوصية الاستقالة ومبدأ استمرارية سير المرفق العام بانتظام

Résumé: الملخص: الاستقالة ظاهرة قانونية في القانون العام، لها أسسها وقواعدها المتميزة النابعة من ارتباطها الوثيق بالطبيعة القانونية التنظيمية اللائحية للعلاقة التي تربط الموظف العام بالإدارة. ومع ذلك لم تعط معظم التشريعات تعريفا جامعا للاستقالة، وركزت على الجانب الإجرائي لها باعتبارها سبب من اسباب قطع العلاقة الوظيفية، وما يميزها عن غيرها من الأسباب أنها تتم بمبادرة وطلب من الموظف العام وعلى انفراد تجاه إدارته. وهو ما يترتب عليه آثار قانونية على الإدارة من حيث سير المرفق العام بانتظام واطراد إضافة إلى تأثيرها على المسار المهني للموظف العام بكونها تضع حدا نهائيا لخدمته. إن الاستقالة تشكل عموما في نظر الإدارة تهديدا لسير المرفق العام، ومساسا بالأمن الوظيفي، وهذا نابع من تأثر وطغيان مبادئ المرفق العام بالقانون الإداري القائمة على ديمومة المرفق العام واحتكار جهد الموظف، وإن أضحى هذا التهديد أقل من الماضي بتزايد الإمكانيات المادية والبشرية للإدارة ما يمكنها من تفادي أي اضطراب أو تجاوز تحدثه استقالة الموظف العام. Abstract: Resignation is a legal phenomenon in public law, with its foundations and distinct rules stemming from its close association with the legal and regulatory nature of the relationship between the public official and the administration. Most legislation does not define resignation and has focused on its procedures as one of the reasons for breaking the job relationship. What distinguishes the resignation from other reasons is that it is done with the individual will of the staff member rather than with the will of the administration, which has legal implications for the administration in terms of the regular functioning of the public services and its impact on the professional career of the public official by putting a definitive end to his or her service. Resignation was a threat to the proper functioning of the public services. It violated the principle of the durability of the public services and the monopoly of the staff member's effort, although that threat was declining because of the Department's increased material and human resources to avoid any disruption or abuse caused by the resignation of the public servant
