Résumé: يعد موضوع العلاقة بين القانون الدولي والقانون الداخلي أو الوطني من الموضوعات التي شهدت نقاشات واسعة على الصعيد الفقهي الدولي؛ ويرجع ذلك إلى بدايات ظهور القانون الدولي وظهور بوادر العلاقة بينه وبين قانون أخر؛ أقدم منه من حيث الوجود؛ وهو القانون الداخلي للدول؛ ويكمن واقع العلاقة التي ظهرت بين القانونيين في وجود قانون ينظم العلاقات في الدولة؛ سواء العلاقات القائمة بين الأفراد؛ أو تلك القائمة بين الأفراد والدولة، أي أنه قانون يحكم سلوك الأفراد والدولة؛ حيث يعتبر الدستور الوطني لأي دولة في علاقتة بالقانون الدولي من خلال التعهدات والاتفاقيات الدولية التي تصادق عليها هذه الدولة؛ وبالتالي يصبح لها مكانة تعلو القانون الداخلي من قانون عضوي وعادي وتنظيمي؛ وتقل درجة من الدستور؛ وهذا طبقا للمادة 154 من دستور 2020.
