دور الخبير القضائي في تدقيق المنازعات التجارية -دراسة حالة خبرة قضائية محاسبية

Résumé: تهدف دراستنا إلى إبراز الأدوار الرئيسية للخبير القضائي المحاسبي في كشف اللبس حول المنا زعات التجارية. إستعملنا في الجزء الأول من الدراسة المنهج الوصفي التحليلي وحاولنا فيه التعرف على الخبير القضائي المحاسبي وكذلك المنازعات التجارية وإجراءات تدقيق المنازعات التجارية ومعايير الخبرة القضائية المحاسبية وتناولنا أيضا عرض وتحليل الدراسات السابقة. أما الجزء الثاني فتطرقنا إلى دراسة نم وذج لتقرير خبرة قضائية محاسبية ا ولوصول إلى نتائج المسألة المطروحة. إن الخبرة القضائية المحاسبية في النزاعات التجارية من المواضيع الجديدة والجديرة بالدراسة قضائيا وإقتصاديا، ا ولتي من خلالها ركزنا على قدرة الخبير القضائي المحاسبي في مساعدة القاضي لتمكينه من إصدار الحكم الصائب في النزاع التجاري المطروح. وأخيرا خلصت دراستنا إلى أن الخبير القضائي المحاسبي له دورا هاما في تدقيق المنازعات التجارية وذلك من خلال المهام المسندة إليه من طرف القاضي وذلك عبر تقرير الخبرة المحاسبية الذي يعد ، مساهما في كشف حالات اللبس في القضايا التجارية وذلك لتحقيق العدالةOur study aims to highlight the role of the Forensic Accountant in revealing the truth during commercial disputes. In the first part of the study, we used the descriptive analytical method, in which we tried to identify the Forensic Accountant,and the commercial disputes, and the procedures for auditing commercial disputes and standards of Forensic Accounting. As well as our presentation and analysis of the previous studies. The second part of the study includes a study of Forensic Accountant report and reach its results. Forensic accounting in commercial disputes is one of the new topics that should be studied judiciously and economically, through which we focused on the ability of the Forensic Accountant to help the judge to enable him to make the right judgment in the commercial dispute. Finally, our study concluded that the Forensic Accountant has an important role in the auditing of the commercial disputes through the tasks entrusted to him by the judge and that's through the Forensic Accounting report, contributing to the reveal of the confusion in commercial cases and to achieve justice.
