عقــــــــــوبة الإعدام بين تحدي المـــــعـــارضة و ضرورة الإبقــــــاء "the Death Penalty Between : The Challenge Of Opposition And The Necessity Of Retention."

Résumé: تختلف الجزاءات الجنائية عن الجزاءات القانونية الأخرى . و تتميز عنها سـواء من حيث طبيعتـها أو من حيث كيفية تنفيذها ؛ و خصوصيتها تنطوي على صورة معينة منها هي: "العقـوبات" المقررة أساسا لحماية حقوق و مصالح و قيم جديرة بحماية مشددة . و لعل أقدم عقــوبة عرفتها القـوانين و طبقتها المجتمعات :" الإعدام" ؛ قديم و شديد الوقع هذا الجزاء فهو يسلب المحكوم عليه حقه في الحياة؛ بشأنه ثار جدل فقهي كبير و تباينت مواقف التشريعات الجزائية للدول. بين معارض متمسك بفكرة أنسنة العقوبة و مؤيد مقتنع بضرورتها للتصدي للجرائم الخطيرة . حول هذا المضمون تدور هذه الدراسة. The criminal penalties diverge from other legal sanctions, distinguished by both their nature and mode of implementation. Their distinctiveness embodies a specific form, namely "punishments," primarily designated to safeguard rights, interests, and values deemed worthy of stringent protection. Among the oldest penalties known to laws and enforced by societies is "capital punishment"; ancient and profoundly impactful, as it deprives the condemned individual of their right to life. This penalty has sparked substantial jurisprudential debate, leading to varied stances within the criminal legislations of nations, between opponents staunchly advocating for the humanization of punishment and proponents firmly convinced of its necessity in addressing severe crimes. This study revolves around this contentious issue.
