النظام القانوني للفضاء الخارجي Legal Regime For Outer Space

Résumé: ملخص: الفضاء الخارجي هو ذلك الفضاء الذي يعل والمجال الجوي الوطني والمجال الجوي الدولي، وكان أول حدث في تاريخ الإنسانية في مجال غزو الفضاء الخارجي: إطلاق المركبة الفضائية السوفيتية (Spoutnik) عام 1957، وقد أدى ذلك إلى بداية الاهتمام الدولي بمجال الفضاء الخارجي، وكذا اهتمام منظمة الأمم المتحدة بالمسألة، وتلا ذلك إرسال المركبة الفضائية الأمريكية Apollo إلى سطح القمر عام 1969 من أجل إجراء بحوث واستكشافات هناك. مع تزايد الاهتمام بالفضاء الخارجي واستغلاله، وتطور التكنولوجيا الفضائية قررت منظمة الأمم المتحدة تنظيم هذا النشاط تنظيماً قانونياً يسد الفراغ الموجود آنذاك الخاص بتنظيم الاستخدام السلمي للفضاء الخارجي، وإقرار المسؤولية الدولية المرتبطة عن هذه النشاطات من مخاطر استعمال الفضاء الخارجي إلى التلوث المفترض جراء هذا الاستعمال. Abstract : Outer space is that space above the national airspace and the international airspace, and it was the first event in the history of humanity in the field of the invasion of outer space: the launch of the Soviet spacecraft (Spoutnik) in 1957, and this led to the beginning of international interest in the field of outer space, as well as the interest of an organization The United Nations dealt with the issue, and this was followed by the dispatch of the American spacecraft, the Apollo, to the surface of the moon in 1969 in order to conduct research and exploration there. With the increasing interest in and exploitation of outer space, and the development of space technology, the United Nations decided to organize this legal activity that fills the void that existed at the time for regulating the peaceful use of outer space, and acknowledging the international responsibility associated with these activities from the risks of using outer space to the supposed pollution resulting from this use.
