السلطة التقديرية للوزير المكلف بالرياضة عند منح قرار الاعتراف بالمنفعة العمومية و الصالح العام للاتحاديات الرياضية

Résumé: إن تنظيم الحركة الرياضية تقتضي تدخل الدولة كطرف أساسي باعتبارها إحدى أشخاص القانون العام ممثلة في وزارة الشباب و الرياضة التي بدورها ترسم الخريطة الرياضية في إطار السياسة الوطنية و بالتنسيق مع مختلف الاتحاديات الرياضية الوطنية من أشخاص القانون الخاص المكلفة بمهمة المرفق العمومي و ذلك بهدف تنفيذ السياسة الوطنية الرياضية .غير أن للوزير المكلف بالرياضة دور مهم في تحديد مختلف السلطات الفيدرالية و ذلك عند منح كل من قرار الاعتراف لكي يتسنى للاتحاديات الحصول على مختلف الإعانات.غير أن للوزير الحرية التامة و السلطة التقديرية عند منح الاعتراف بالمنفعة العمومية و الصالح العام بعد استفاء الاتحاديات الرياضية لجميع الالتزامات القانونية Organizing the sports movement requires the intervention of the state as a primary party as it is a public law person represented by the Ministry of Youth and Sports, which in turn draws the sports map within the framework of national policy and in coordination with the various national sports federations of private law persons entrusted with the task of the public utility, with the aim of implementing the national policy Sports. However, the Minister in charge of sports has an important role in determining the various federal authorities when granting the recognition decision so that the federations can obtain various subsidies. However, the Minister has complete freedom and discretion when granting recognition to the public benefit and the public interest after the sports federations are satisfied. for all legal obligations
