قضايا الزواج بالغرب الإسلامي من خلال نوازل ابن الحاج التجيبي القرطبي (ت529هـ)

Résumé: ملخص: تضمّنت كتب النوازل الفقهية في طيّاتها العديد من القضايا والمسائل المتعلقة بشئون الأسرة كالعلاقات الزوجيّة مثلا، ولقد أصبح اعتماد المؤرخين على هذه الكتب كمصدر رئيس للتأريخ للجانب الاجتماعي والاقتصادي وذلك لملء الفراغ الموجود في كتب الحوليات التاريخية، اختص الغرب الإسلامي بهذا النوع من المؤلّفات والتي استمدّت خصوصيّتها من المذهب المالكي كنوازل ابن رشد وابن سهل والونشريسي وغيرهم، ولعلّ من أهمّها ما كتبه القاضي الشّهيد ابن الحاج التجيببي القرطبي (ت529ه) الذي عاصر فترتين حسّاستين من تاريخ الأندلس فترة ملوك الطوائف وكذا عصر المرابطين. نحاول في هذه الورقة البحثية تسليط الضوء على بعض القضايا من نوازل ابن الحاج المتعلّقة أساساً بالأسرة والتي تمسّ جانبين هامّين هما : الزواج، والطلاق. Abstract: The books of contemporary issues fiqh included many matters end issues related to family, like marital relationships as an example and those books where used by historian. As a major source of their accounts of social and economic aspects and to fill the gaps in history books these types of contemporary issues fiqh were a speciality of the Islamic occident and these was due to Maliki fiqh school impact speciality on the books of Nawazil Ibn roshd, Ibn sahl, Alwancharissi etc. one of the main books in this filed was written by Alkadi Ibn el-Hadj el-Tajibi (529h) who witnesses two sensitive aras of Andalucia: The Morabitine and Muluk at-Awaef . This paper we try to shed light on some issues talked in the books of Ibn el-Hadj contemporary issues fiqh Especially marriage and divorce.
