عقد استغلال العقارات الوقفية العامة كآلية مستحدثة لاستقطاب الاستثمارات "دراسة في المرسوم التنفيذي رقم 213/18"

Résumé: من نافلة القول نقر بأن الاستثمار جوهر التنمية الاقتصادية وعامل مشجع للنهوض باقتصاديات الدول على المستوى الداخلي والدولي معا، ولهذا يجب على كل دولة أي كانت تسعى دائما وراء مواكبة التغيرات السياسة الاقتصادية من خلال سن تشريعات تتوافق مع هذه السياسة، وبناء على ذلك تبنى المشرع آلية مستحدثة يتأتى أساسها القانوني من المرسوم التنفيذي 18/213، بحيث تسعى هذه الوسيلة إلى تثمير الأملاك الوقفية العامة بهدف الاستثمار فيها وتنميتها لإخراجها من دائرة الاستغلال الذاتي نحو فتح آفاق جديدة لتكون من الدوافع المستقطبة للاستثمار. ولهذا تهدف دراستنا إلى تبيان الأحكام القانونية الناظمة لهذه العلاقة التعاقدية. It goes without saying that we acknowledge that investment is the essence of economic development and an encouraging factor for the advancement of the economies of countries at the internal and international levels together, and for this every country, i.e. it has always sought to keep pace with changes in economic policy by enacting legislation compatible with this policy, and accordingly the legislator adopted an innovative mechanism Its legal basis comes from Executive Decree 18/213, so that this method seeks to invest public endowment properties in order to invest in and develop them in order to remove them from the circle of self-exploitation towards opening new horizons to be one of the motives that attract investment. Therefore, our study aims to clarify the legal provisions governing this contractual relationship.
