ضوابط الرقابة القضائية على دستورية القوانين -دراسة في الفقه والقضاء الدستوري المقارن-

Résumé: تعتبر الرقابة الدستورية من أهم الوظائف الرقابية التي تقوم بها المؤسسات الدستورية داخل الدولة، وهي العملية التي تقوم بها هيئة سياسية تسمى عند أغلب الأنظمة السياسية المقارنة بالمجلس الدستوري، أو هيئة قضائية من خلال محكمة مخصصة لذلك. وتتمثل تلك الوظيفة الرقابية في مراقبة مدى موافقة القانون والتنظيم لأحكام الدستور، ومن هنا يتبين بأن عمل الرقابة الدستورية يقع أساسا على أعمال السلطة التشريعية. غير أنه لا يجوز مضايقة السلطة التشريعية في وظيفة سن القوانين؛ فالرقابة الدستورية تخضع لضوابط تتعلق أساساً بالتقيد بأحكام الدستور، وأن لا تتعلق تلك الرقابة بضرورة التشريع وملاءمته للأوضاع السياسية والاجتماعية، ولا ببواعثه، وأن لا تنصب على أعمال السيادة. Constitutional control is one of the most important control functions performed by constitutional institutions within the state, and it is the process performed by a political institution called in most comparative political systems, the Constitutional Council, or a judicial institution through a court designated for that. This control function is to monitor the extent to which the law and regulation comply with the provisions of the constitution, and from here it becomes clear that the function of constitutional control rests mainly on the work of the legislative authority. However, the legislature may not be harassed in the function of enacting laws; Constitutional control is subject to controls mainly related to adherence to the provisions of the constitution, and that this oversight is not related to the necessity of legislation and its suitability to political and social conditions, nor to its motives, and that it is not focused on acts of sovereignty.
