Résumé: الوقف من الأعمال الخيرية، التي جعلها الله تبارك وتعالى، يستفيد منها الإنسان في حياته، وتبقى صدقة جارية يلحقه ثوابها بعد موته. وقد تنافس المسلمون على هذا العمل الخيري حتى أصبح ظاهرة اجتماعية تميز المجتمع المسلم، والمجتمع الجزائري من ضمنه. وهذه الدراسة هي، بحث حول الأوقاف ووضعها في فترة الاحتلال الفرنسي للجزائر، وكيف تعاملت السلطات الإستدمارية معها؟ أما الغرض منها، هو الوقوف على أهم القرارات والقوانين والمراسيم التي أصدرتها سلطات الاحتلال تخص الأملاك الوقفية، حيث اعتبرت وضعية الأراضي والعقارات وملكيتها عائقا وحاجزا أمام تنفيذ سياستها الاستعمارية، وعلى إحكام السيطرة على مقدرات وخيرات البلاد. ومن أجل إزالة هذه العقبات، عملت منذ بداية الاحتلال على اتخاذ مجموعة من الإجراءات وسن القوانين وإصدار المراسيم للحد من سلطة المؤسسات الوقفية، ووضع اليد على أراضي الجزائريين وممتلكاتهم وتحويلها إلى ملكية فرنسية تتصرف فيها بما يخدم مصالحها، خاصة سياسة الاستيطان التي كانت الأوقاف سدا منيعا ضدها. The wakf, is one of the charitable works, that Allah blessed and almighty, Has made. benefiting man in his life and after his death, and Muslims have competed for this charitable work as it become a social phenomenon that distinguishes the Muslim community, and Algerian society, including. This study is a research on endowments (Awkaf) and their status during the French occupation of Algeria, and how did the administrative authorities deal with them? As for its purpose, it is to identify the most important decisions, laws and decrees issued by the occupation authorities concerning endowment properties, as the status of lands and real estate and their ownership were considered an obstacle and a barrier to the implementation of their colonial policy, and to tighten control over the country's resources. In order to remove these obstacles, it has worked since the beginning of the occupation to take a series of measures, enact laws and issue decrees to limit the authority of the Wakf institutions, and seized the lands and properties of the Algerians and turned them into French property to dispose of them in a way that serves their interests, especially the settlement policy, against which the endowments were an impregnable barrier.
