الدستور ومكانة الحقوق والحريات

Résumé: نحاول من خلال هذا البحث إظهار الدور الذي يلعبه الدستور في تعزيز وحماية حقوق وحريات الإنسان فتكريس الحقوق والحريات في الدستور هو عماد الحكم العادل، ومقياس لشرعية السلطة وممارستها، فاحترام الحقوق والحريات اليوم يعد التزاما دوليا يقع على عاتق الدولة أمام المجتمع الدولي، ولهذا قسمنا هذا البحث إلى مبحثين تعرضنا في الأول للإطار الفكري والإطار القانوني لالتزام المشرع الدستوري بتكريس الحقوق والحريات في الدساتير، ثم تعرضنا في المبحث الثاني للضمانات التي تعمل على حماية حقوق وحريات الإنسان. We try through this research to show the constitution’s role in promoting and protecting human rights and freedoms. Human rights and freedoms inclusion in the constitution is the mainstay of fair governance, measure of legitimacy and exercise of the power. Today, respecting rights and freedoms is an international commitment that lies with the state before the international community. This research is divided into two parts: the first one deals with the intellectual and legal framework of the constitutional project’s commitment to include rights and freedoms in constitutions. The second part deals with the protection assurances of human rights and freedoms.
