Résumé: يعتبر عقد البيع على التصاميم تقنية أوجدها المشرع الجزائري للحد من مشكل السكن بموجب القانون رقم 11- 04 المتعلق بالقواعد التي تنظم نشاط الترقية العقارية، فيرتب هذا العقد آثارا تتمثل في إلتزامات متقابلة في ذمة طرفي العلاقة التعاقدية، المرقي العقاري البائع على التصاميم، الطرف القوي، الذي يلتزم بالإنجاز والمطابقة، وعليه تقديم ضمانات إنجاز البناء من الضمان العشري إلى ضمان إدارة الأملاك المنجزة وسير عناصر تجهيزاتها، وضمان الانهاء الكامل لأشغال الإنجاز، وتسليمه خلال المدة المحددة من جهة، والمكتتب المشتري على التصاميم، الطرف الضعيف، الذي عليه دفع الثمن على أقساط محددة، وتسلم العقار عند الإنتهاء من الإنجاز، ويترتب على ذلك آثارا تمثلت في استحقاق الأجر الباقي مع بدأ سريان مدد الضمانات، وانتقال تبعة هلاك العقار، وانتقال حق التصرف في العين المبيعة إلى المكتتب، من جهة أخرى. The sales contract for designs is a technology created by the Algerian legislator to reduce the housing problem according to Law No. 11-04 related to the rules that regulate the real estate promotion activity, the real estate developer selling the designs, the strong party, which is committed to completion and conformity, and he must provide guarantees for the completion of construction, and its delivery within the period specified by one side, and the subscriber buying the designs, the weak party In, who has to pay the price in specific installments, and hand over the property at the completion of the completion, the transfer of responsibility for the loss of the property, and the transfer of the right to dispose it, by another side .
