خصوصية البطلان في عقد البيع على التصاميم وفق قواعد نشاط الترقية العقارية.

Résumé: الملخص: شدَّد المشرع الجزائري في عقد البيع على التصاميم على ضرورة التطبيق الصارم لأحكام وقواعد الترقية العقارية، كون أن محل العقد غير موجود أثناء التعاقد، والذي سيعمل المرقي العقاري(البائع) على بِنَائِه، فربط تسيير هذا العقد بأحكام كل من القانون90-29 المتعلق بالتهيئة والتعمير، والقانون رقم08-15 المتعلق بمطابقة البنايات وإتمام إنجازها، وكذا المرسوم التنفيذي15-19 الذي يحدد كيفيات تحضير عقود التعمير، حيث رَتَّبَ له بطلانا مطلقا خاصا كجزاء للإخلال بقواعد البناء والمتمثلة في أحكام رخصة البناء وشهادة المطابقة، مع بطلان خاص أيضا متمثل في الإخلال بالنموذج الرسمي للعقد ومضامينه كعدم توضيح تشكيلة سعر البيع، وآجال الدفع، وطريقة تسديد الدفعات، وصيغة مراجعة السعر. Abstract: The Algerian legislator stressed in the sales contract on the designs the necessity of strict application of the provisions and rules of real estate promotion, since the place of the contract does not exist during the contract, which the real estate developer (the seller) will work on building, so he linked the conduct of this contract to the provisions of each of Law 29-90 related to preparation and reconstruction, And Law No. 15-08 related to the conformity of buildings and the completion of their completion, and Executive Decree 15-19 that determines the methods of preparing and handing over construction contracts, as it arranged for it an absolute and special invalidity as a penalty for breaching the building rules represented in the provisions of the building permit and the certificate of conformity, with a special invalidity also represented in the violation of the official form of the contract And its contents, such as not clarifying the variety of the sale price, payment terms, method of making payments,and the formula for reviewing the price.
