الاختصاص القمعي لسلطة ضبط السمعي البصري على ضوء القانون رقم 14/04 المتعلق بالنشاط السمعي البصري .

Résumé: I. الملخص بالعربية: نتيجة مخرجات العولمة الاقتصادية والتوجه نحو اقتصاد السوق وفتح المجال أمام المبادرة الخاصة،ظهرت هيئات إدارية مستجدة في بناء وهيكل الدولة الجزائرية،مستوحاة من النموذج الغربي تختلف عن الإدارة التقليدية،تتمثل هذه الهيئات في السلطات الإدارية المستقلة. تولت هذه السلطات مهمة ضبط السوق بعد الانسحاب التدريجي للدولة من تسيير جل القطاعات المالية، الاقتصادية وحتى الاعلامية ،في هذا السياق، تم استحداث سلطة ضبط السمعي البصري ،بموجب القانون رقم 14/04 مع منحها عدة اختصاصات،منها الاختصاص القمعي،بغرض تحقيق التوازن داخل القطاع الذي تشرف عليه ،مع أن اختصاص القمع هو اختصاص أصيل للقاضي، بحثا عن الفعالية والسرعة في قطاع يطبعه التعقيد و التقنية. الكلمات المفتاحية بالعربية: سلطة ضبط ؛ سمعي بصري؛ عقوبات إدارية؛ سلطة قمعية. I. ABSTRACT: As a result of of the outcomes of economic globalization and the oreintation towards a market economy , opening the way for private initiative and freedom of competetion,new institutions appeared in the construction and structure of the Algerian state,wich different from the traditional administration and inspired by the western model , these is the independent administrative authorities. These authorities assumed the control of the market after the retreating of the state from managing the financial , economic and media sectors,in this context, the audivisual control authority was created by law and granted several autorities which is repressive authoritythough repression is the jurisdiction of the judgen in search of efficejcy and speed in this sector wich characteriezed by coplexityand technology .
