التزام بالسلامة على ضوء التقدم العلمي والتكنولوجي

Résumé: لقد غيرت الجزائر النهج الاقتصادي بتبني نظام الاقتصاد الحر والذي أكّد عليه دستور 1989 ثم تكرّس بالترسانة القانونية التي برزت استجابة له، وقد صاحب هذا التحول تطور العلمي والتكنولوجي كبير لصناعة المنتوجات في دول العالم وغزو الشركات للأسواق الدولية الوطنية، وأضحى يشكل خطرًا كبيرا على المستهلك، الذي تهدده مخاطر المنتجات حيث تحمل العديد من العيوب والأضرار التي لا تظهر بالفحص العادي وقد تبرز بعد مرور وقت كبير، وفي هذا الإطار يكون المنتج الحلقة الأقوى في عقد الاستهلاك ويثور التساؤل حول تفعيل الالتزام بالسلامة في هذه المنتجات المتطورة كآلية لحماية المستهلك، حتى يستفيد من تلك المنتجات من جهة وتوفر له بيئة آمنة تضمن صحته وسلامته، وقد اعترف المشرع الجزائري بالالتزام بالسلامة، وكرّسه كآلية تحمي المستهلك، وسوف يتم التركيز في هذه الورقة البحثية على الالتزام بالسلامة بين القواعد التقليدية والحديثة. Abstract: Algeria has changed the economic approach by adopting the free economy, which was affirmed by the 1989 Constitution and then devoted to the legal arsenal that emerged in response to it. This transformation was accompanied by the great scientific and technological development of the manufacturing industry in the countries of the world and the invasion of companies in the international markets. The product is threatened by the risks of products, where it carries many defects and damages that do not appear in the normal examination may emerge after a considerable time, and in this context is the product is the strongest link in the decade of consumption and raises the question of activating the commitment to safety in these products developed as a mechanism to protect the Algerian legislator has recognized the commitment to safety and has dedicated it as a mechanism to protect the consumer. The focus of this research paper will be on the commitment to safety between traditional and modern rules.
