موجبات الحجر الصحي في الفقه الإسلامي والتشريع الجزائري Obligations Of Quarantine In Islamic Jurisprudence And Algerian Legislation

Résumé: يعالج هذا المقال إشكالية العلاقات المنظمة لحياة الأشخاص زمن الأوبئة وانتشار الأمراض المعدية؛ إذ يتعلق الأمر بالحجر الصحي الذي يرتبط في نفس الوقت بالدولة وسلطتها على الأشخاص مفهوما وواقعا . ونريد أن نبين بصورة موجزة أن المقاربة السوسيولوجية للحجر الصحي الأكثر مشروعية تكمن في ضوابط متعددة مستمدة من الشريعة الإسلامية والفقه القانوني لها أبعاد طبية، تاريخية، ووظيفية حيث يبرز دور الإدارة في الفهم الشامل لهذه الآلية. Abstract This article addresses the problematic relations regulating the lives of persons in the period of epidemics and spread of infectious diseases, where it comes quarantine, which is linked at the same time the state and its authority over the people in terms of concept and reality. In this paper, we show briefly that the sociological approach of quarantine the most legality represented in multiple controls are derived from Islamic law and jurisprudence have medicinal dimensions, historical, and functional, where highlights the role of administration in the overall understanding of this mechanism.
