السلطة العليا للشفافية والوقاية من الفساد ومكافحته في ظل التعديل الدستوري لسنة 2020

Résumé: في إطار سياسة الوقاية من الفساد ومكافحته انشئت للدولة العديد من المؤسسات كآليات للوقاية من الفساد ومكافحته، ولعل من أبرزها السلطة العليا للشفافية والوقاية من الفساد التي انشئت سنة 2006 بموجب القانون رقم 06-01 تحت تسمية الهيئة الوطنية للوقاية من الفساد ومكافحته، ونص عليها المؤسس الدستوري لأول مرة في التعديل الدستوري لسنة 2016، كما غير تسميتها في التعديل الدستوري لسنة 2020 مع تغيير في دورها عن طريق منحها المزيد من الصلاحيات الحقيقية لتبتعد عن الدور الاستشاري نحو الدور الحقيقي في الوقاية ومكافحة الفساد. تعتبر السلطة العليا للشفافية والوقاية من الفساد ومكافحته مؤسسة دستورية مستقلة لا تتبع أي سلطة حيث تنظم وتحدد تشكيلتها وصلاحياتها بموجب قانون خلافا للهيئة الوطنية للوقاية من الفساد ومكافحته التي تم تنظيمها وتحديد تشكيلتها بموجب مرسوم رئاسي لكونها توضع لدى رئيس الجمهورية. Within the framework of the policy of preventing and combating corruption, the state has established many institutions as mechanisms to prevent and combat corruption, and perhaps the most prominent of which is the Supreme Authority for Transparency and Prevention of Corruption, which was established in 2006 under Law No. 01-06 under the designation of the National Commission for the Prevention and Control of Corruption, stipulated by the constitutional founder For the first time in the constitutional amendment of 2016, it also changed its name in the constitutional amendment for the year 2020 with a change in its role by granting it more real powers to move away from the advisory role towards the real role in prevention and combating corruption. The Supreme Authority for Transparency, Prevention and Control of Corruption is an independent constitutional institution that does not follow any authority, as its composition and powers are regulated and defined by a law unlike the National Authority for the Prevention and Control of Corruption, which was organized and defined by a presidential decree because it is placed with the President of the Republic.
