أحاديث الفرق في مرآة المقاصد: دراسة تحليلية من خلال أعمال أبي إسحاق الشاطبي.

Résumé: لقد بحث علماء الأمة ظاهرة الافتراق في الدين تحليلا ونقدا، وكانت أحاديث الافتراق أو الفرق مثار جدل فاختلف في ثبوتها وفي معانيها ومدلولاتها الشرعية. تأتي هذه الورقة البحثية للنظر في المقاربات التي وظفت لقراءة هذه الأحاديث، والتركيز على المقاربة المقاصدية لإعادة الفهم في ضوء مقاصد الشريعة . وقد خلص البحث إلى أن القصور في فهم حديث الفرق وأمثلتها من نصوص الشريعة سببه معالجتها بشكل تجزيئي معزول دون تحكيم مقاصد الشريعة. انطلق الشاطبي في معالجته لأحاديث الفرق من ثلاثة مقاصد هي "مقصد الوحدة في الأمة الإسلامية" و"مقصد الصلاح" و"مقصد الستر". The scholars have discussed the phenomenon of separation in religion in analysis and criticism. The hadiths of separation differed in their validity, their meanings, and their legitimate meanings. This paper comes to look at the approaches that were employed to read these hadiths, and to focus on the maqasid approach to re-understanding in the light of objectives of the Sharia. The research concluded that the lack of understanding of the hadith of the difference and its examples from the texts of the Shari’a is caused by treating them in an isolated and piecemeal manner without judging the objectives of the Sharia. Al-Shatibi started in his treatment of the hadiths of the sects from three objectives: “the aim of unity in the Islamic nation,” “the purpose of goodness,” and “the purpose of concealment.”
