الاعتراف بالشخصية القانونية لأنظمة الذكاء الاصطناعي: ضرورة أم مغالاة؟

Résumé: تشكل أنظمة الذكاء الاصطناعي في الوقت الراهن تحديات جديدة للمفاهيم التقليدية للقانون، خاصة في مجال الشخصية القانونية، فالمنظومة القانونية لم تنظم مثل هذه الحالات، والمتعارف عليه قانوناً أن منح الشخصية القانونية يكون إما للشخص الطبيعي أو للشخص الاعتباري، ما جعل جانباً من الفقه يعارض فكرة منح الشخصية القانونية لهذه الأنظمة. وقد تناولنا الاعتراف بالشخصية القانونية لأنظمة الذكاء الاصطناعي من خلال مبحثين: تناول المبحث الأول مدى تمتع أنظمة الذكاء الاصطناعي بالشخصية القانونية، بينما استعرض المبحث الثاني قدرة هذه الأنظمة على التعاقد. وقد خلصت هذه الدراسة إلى ضرورة إعادة النظر في فكرة الشخصية القانونية، وإمكان الاعتراف لأنظمة الذكاء الاصطناعي بشخصية قانونية تتلاءم مع طابعها الخاص، بالإضافة إلى عدم كفاية التشريعات القائمة لمواجهة الجدل القائم حول تمتع هذه الأنظمة بالشخصية القانونية، فهي بحاجة إلى إجراء تعديلات تشريعية تضمن منح أنظمة الذكاء الاصطناعي شخصية قانونية افتراضية خاصة بها تخولها القدرة على إبرام العقد وتنفيذه وإجراء المفاوضات العقدية. Artificial intelligence systems currently pose new challenges to traditional concepts of law, especially in the field of legal personality. The legal system has not regulated such cases, and it is legally accepted that granting legal personality is either to a natural person or to a legal person, which has made a part of jurisprudence oppose the idea of granting legal personality. The legal personality of these systems. We presented the recognition of the legal personality of artificial intelligence systems through two sections: the first section dealt with the enjoyment of legal personality by artificial intelligence systems, while the second section reviewed the ability of these systems to contract. This study concluded that it is necessary to reconsider the idea of legal personality, and to recognize artificial intelligence systems with a legal personality that is compatible with their special character, in addition to the inadequacy of existing legislation to confront the existing controversy over these systems’ enjoyment of legal personality. They need to make legislative amendments to ensure that intelligence systems are granted The artificial entity has its own virtual legal personality that gives it the ability to conclude and implement a contract and conduct .contractual negotiations
