Résumé: تتضمن دراسة المسؤولية الجنائية للشريك البحث في ثلاثة موضوعات، الأول هو بيان حقيقتها وتمييزها عن المساهمة الأصلية، والثاني هو بيان صورها في القانون الجنائي الوطني، والثالث هو بيان العقوبة التي يقررها لها القانون الدولي. فبينت حقيقة المسؤولية الجنائية للشريك موضحا أنواعها ومظهرا أحكامها وأوصافها العامة التي تظهر حقيقتها، وتميزها عن المساهمة الأصلية، فالمساهمة التبعية هي تعدد المجرمين في مرحلة ما قبل التنفيذ المادي للجريمة، أي هي مرحلة التفكير والإصرار على ارتكاب الفعل المجرم. ثم بعد ذلك قمت بدراسة حالات المساهمة التبعية في القانون الجنائي الدولي ، ووجدت أن القانون الجنائي الدولي يرى أن الاشتراك في الجريمة بأية طريقة من الطرق الواردة في المادة 25 من نظام روما الأساسي يعد فعلا عمديا ، فلا يمكن أن يتوافر الاشتراك بطريق الخطأ أو الإهمال. وفي الأخير قمت بتحديد عقوبة الشريك في القانون الجنائي الدولي.
