Résumé: ملخص : تلعب الانتخابات بأشكالها دورا حاسما في إشراك الشعب في ممارسة السلطة، و هي بذلك تجسد بحق الضمانات الأساسية لتحقيق الديمقراطية. ومن أجل ذلك أوجب المشرع الانتخابي الجزائري آلية لضمان الانتخابات يهدف من خلالها نزاهة هذه العملية منذ بدء المرحلة التحضيرية وما يتعلق بها من سير يمس ضوابطها الزمنية أو المادية إلى غاية التصويت وما يخص حسن سيره كالتأثير على أصوات الناخبين ثم الفرز و إعلان النتائج وما يحدث من تغيير بنتائج الأصوات ونزاهتها . فقد أكد المشرع على مرافقة العملية الانتخابية في جميع مراحلها، وتجريم كل ما يخل بهذه العملية بل والتشديد في العقوبة المقررة إن توافرت الظروف لذلك، ومهما كانت صفة القائم بالفعل مرشح، ناخب أو إداري. الكلمات المفتاحية : العملية الانتخابية، الجرائم، العقوبات، التشريع الانتخابي، الناخب، المرشحين، النزاهة. Summary :: Elections, in their forms, play a crucial role in the participation of the people in the exercise of power, thus constituting the fundamental guarantees of democracy. For this reason, the Algerian electoral legislator needed a mechanism to guarantee the elections, the aim being to preserve the integrity of this process from the beginning of the preparatory phase and the related process affecting its temporal or material control until the holding of the ballot and its proper functioning, notably by influencing the vote of the electors.
