دور القانون فى حماية البيئة The Role Of The Law Inprotecting The Environment

Résumé: أصبحت البيئة عُرضة للاستغلال غير الرشيد مع ميلاد الثورة الصناعية في النصف الثاني من القرن التاسع عشر, وإدخال الملوثات -من مواد كيميائية وصناعية ونفايات المصانع- مما أدى للحاجة المُلحة لقواعد قانونية تحكم سلوك الإنسان في تعامله مع بيئته. وللحفاظ على الثروات الطبيعية في الدولة من التلوث صدرت العديد من القوانين البيئية, حتى أن بعض الدول ذهب اهتمامها بالبيئة إلى حد جعل الحفاظ عليها مبدأ دستوري، كالدستور الهندي لسنة 1976. يتناول البحث مفهوم البيئة وتعريفها, والوسائل القانونية لحمايتها, كما يتعرض البحثللجزاءات المترتبة على مخالفة الإجراءات الخاصة بحماية البيئة. الكلمات المفتاحية : البيئة, القانون, الثورة الصناعية, الملوثات, الثروات الطبيعية. Abstract: The environment became vulnerable to irrational exploitation with the birth of the industrial revolution in the second half of the 19th century, and the introduction of pollutants - chemicals, industrial and factory waste - which led to the urgent need for legal rules governing human behavior in dealing with its environment. In order to preserve the state's natural resources from pollution, many environmental laws have been passed, and some states have even gone so far as to make their preservation a constitutional principle, such as the Indian Constitution of 1976. The articledeals with the concept and definition of the environment, the legal means to protect it, and the sanctions resulting from violating the procedures for protecting the environment.
