الحماية القانونية الدولية لبراءة الإختراع في ظل اتفاقية باريس لسنة 1883 International Legal Protection Of Patent Under Paris Convention 1883

Résumé: الملخص: تهدف هذه الدراسة إلى إبراز سبق اتفاقية باريس في الإهتمام بحقل الملكية الصناعية والذي يعتبر الشق الهام في مجال الملكية الفكرية، لما يلعبه من دور محوري وحيوي في تنمية اقتصادات الدول، لاسيما إذا علمنا أن الملكية الصناعية تعد إكسير التطور الإقتصادي والتقدم التقني في الدول المتقدمة. كما سنركز في دراستنا هذه على ميدان محدد في مجال الملكية الصناعية، ألا وهو ميدان براءة الإختراع، نظرا لما اكتسته هذه الأخيرة من أهمية متعاظمة لدى العديد من الدول – لاسيما الصناعية منها -، وهي إذ ذاك عكفت على تأطير مجال الملكية الصناعية عموما وبراءة الإختراع خصوصا بأحكام قانونية صارمة منصوص عليها بجلاء في اتفاقية باريس للملكية الصناعية لسنة 1883، باعتبار هذه الأخيرة هي السبّاقة في وضع اللبنات الأساسية للحماية الدولية لبراءات الإختراع بما سنته من أحكام ومبادئ دولية متكاملة، تلتها في ذلك العديد من الإتفاقيات في سبيل تعزيز هذه الحماية، لاسيما اتفاقية واشنطن في 19 جوان 1970 بما وضعته من تدابير وإجراءات تسهم في هذه الحماية. Abstract : This study aims to highlight the big Importance of Paris Convention in the field of industrial property especially, and the intellectual property in general, because it plays an essential role in the development of countries' economies, especially if we know that industrial property is the elixir of economic development and technological progress in developed countries. In this study we will also focus in a specific area in industrial property, which is the field of patents, given its growing importance in many countries - in particular industrial countries – that were framed the field of industrial property in general and patents in particular by rigorous legal provisions clearly stated in Paris Convention on Industrial Property of 1883, as a precursor to the establishment of the foundations of international patent protection with its integrated international provisions and principles, followed by numerous conventions aimed at strengthening this protection, in particular the Washington Convention of 19 June 1970 with it’s a procedures contributing to this protection.
