قراءة في ديباجة التعديل الدستوري لعام 2016

Résumé: يناقش هذا المقال ما تضمنته ديباجة التعديل الدستوري للعام 2016 لاسيما تلك المواضيع الجديدة التي لا شك أنها تمثل نقلة نوعية في أحكامها. لكن مع ذلك تبقى الأداة القانونية التي بموجبها تم تكريس أحكام هذه الديباجة والتعليلات التي أضفاها المشرع الدستوري عليها محل نظر، من حيث إدخالها في الدستور والتبريرات التي صاحبتها تبقى تفتقد إلى الدقة والصياغة ومراعاة الجوانب القانونية التي كانت سببا في وجود التعديل الدستوري لعام 2016 آملين أن تتلافى الدساتير اللاحقة أو تعديلات الدستور الساري المفعول كل النقائص التي تعتري هذه الوثيقة. الكلمات المفتاحية: تعديل ; ديباجة ; دستور ; المجلس؛ تعليل. Abstract: This article discusses what the preamble to the 2016 constitutional amendment contains, especially those new topics that are undoubtedly a qualitative shift in its provisions. However, the legal instrument under which the provisions of this preamble and the instructions which the Constitutional legislator has added to it remains under consideration. In terms of its constitutional provisions and the justifications that accompanied it, it still lacks accuracy, wording and consideration of the legal aspects that led to the constitutional amendment of 2016, hoping that the following constitutions or amendments to the existing constitution will avoid all the shortcomings of this document. key words: Amendment; preamble; constitution; Council; explanation.
