المحكمة الدستورية على ضوء تعديل الدستور لسنة 2020 بين تكريس الاستقلال العضوي وتوسيع في الصلاحيات

Résumé: استحدث المؤسس الدستوري الجزائري في تعديل سنة 2020 للدستور المحكمة الدستورية كمؤسسة دستورية لتحل محل المجلس الدستوري وهذا في إطار الإصلاحات الدستورية المعمقة، حيث حاول المؤسس الدستوري إعطاء هذه الهيئة الدستورية ضمانات تمكنها من القيام بالمهام المسندة إليها في إطار الاستقلالية، ومن أهم هذه الضمانات طريقة تعيين أعضاءها، حيث استحدث تركيبة جديدة تختلف عن طريقة تعيين أعضاء المجلس الدستوري سابقا لتحسين الأداء الوظيفي للمحكمة الدستورية، بالإضافة إلى إعطاءها مجموعة من الصلاحيات الجديدة مثل صلاحية تفسير الدستور وصلاحية البت في الخلافات التي قد تحدث بين مختلف السلطات محاولا توسيع نطاق تدخلها لضمان مبدأ سمو الدستور وتحقيق العدالة الدستورية في إطار استقلال عضوي ووظيفي. The Algerian constitution Founder during the amendment of the year 2020 , has introduced the constitutional court as a constitutional establishment in order to replace the constitutional council , this change is done as a part of the profound constitution reforms . The constitution Founder tried to give to this board some guarantees to allow it to accomplish the missions conferred upon it in the framework of the autonomy , among the most important guarantees , we may mention the way of designation of its members , as there is a new structure which is different from the way of designating the members of constitutional council previously in order to improve functional performance of the court in addition to reinforcing by a number of new reforms such as the terms of reference regarding the explanation of the constitution and the one related to resolving disputes which could happen among different authorities , so as to widen the framework of its intervention to guarantee the principle of the supremacy of the constitution and to achieve constitutional justice in the framework of the autonomy of these functions.
