دور الخبرة في استخلاص الدليل المادي

Résumé: أوجبت التشريعات الجنائية أن يحصل كل متهم بجريمة على محاكمة عادلة، وهذه المحاكمة العادلة تستوجب على المحكمة أن تستظهر مدى ثبوت التهمة بالنسبة للمتهم أو عدم ثبوتها، فالحكم بالإدانة أو البراءة يحتاج إلى الإثبات الجنائي، والاثبات الجنائي يحتاج إلى إقامة الدليل لدى الجهات المختصة، ومع تنامي ظاهرة الجريمة ، وتحول الإجرام التقليدي إلى إجرام يعتمد على وسائل وأساليب علمية، لجأت الشرطة القضائية إلى الاستعانة بخبراء الشرطة العلمية والتقنية، هؤلاء الذين يقع عليهم عبئ البحث عن الأثار والمخلفات المادية التي يتركها الجاني وراءه في مسرح الجريمة، وكذا جمعها وفحصها باستعانة بمختلف التقنيات والأساليب العلمية الحديثة للوصول الى دليل مادي يقدمه مخبر الأدلة الجنائية في شكل تقرير خبرة بطلب من جهات التحقيق والحكم. Abstract: Criminal legislation mandates that every person accused of a crime must receive a fair trial. Such a fair trial requires the court to determine whether the charges against the defendant are substantiated or not. Judgments of conviction or acquittal rely on criminal evidence, which must be established before the competent authorities. With the rise in criminal activity and the evolution of traditional crime into forms that depend on scientific methods and techniques, the judicial police have increasingly sought the assistance of scientific and technical police experts. These experts are responsible for identifying and collecting physical traces and material remnants left behind by perpetrators at crime scenes. They analyze this evidence using various modern scientific tools and methods to uncover physical evidence. The forensic evidence laboratory presents the results in the form of an expert report, upon request from investigative or judicial authorities.
