الدفع القضائي بعدم الدستورية كضمانة لنفاذ القواعد الدستورية للحقوق والحريات

Résumé: الملخص : حماية لحقوق و حريات الأفراد المكفولة دستوريا ، تبنى المؤسس الدستوري الجزائري آلية الدفع بعدم الدستورية و دلك على إثر التعديل الدستوري لسنة 2016 ، لا سيما المادة 188 منه ، و هدا ضمانا لتمكين الأفراد من ممارسة حقهم في الدفع بعدم دستورية القوانين التي تتضمن انتهاكا لحقوقهم و حرياتهم الأساسية ، أسوة بباقي التشريعات المقارنة في هدا المجال و أبرزها التشريع الفرنسي . فقد أحال تنظيم هده المسألة إلى القانون العضوي الذي تأخر صدوره إلى غاية سبتمبر 2018 على إثر القانون العضوي 18/16 و الدي حدد شروط و كيفيات الدفع بعدم الدستورية و دلك من أجل ضبط كل الأمور المتعلقة بهده العملية و تفادي الإشكالات العملية الناجمة عنها ، إلا أنه رغم دلك لم يسلم هدا النص القانوني من بعض الانتقادات الموجهة إليه بهدا الخصوص نظرا للنقائص العديدة التي اعتلته . الكلمات المفتاحية: الدفع القضائي – عدم الدستورية – الحقوق و الحريات – نفاذ القواعد . Abstract : To protect the rights and liberties of individuals who are constitutionally guaranteed The Algerian constitutional institution adopted the mechanism of non-constitutional reform, following the constitutional amendment of 2016, in particular Article 188 thereof, and this is a guarantee to enable individuals to exercise their right to enforce laws that violate their rights and freedoms As in the case of other comparative legislation in this area, most notably French legislation. The organization of this matter referred to the Organic Law, which was delayed until September 2018, following Organic Law 18/16, which defined the terms and conditions of the payment of unconstitutionality, and in order to control all matters related to the process and avoid the practical problems resulting from it, Despite the fact that this legal text has not been delivered from some of the criticisms against it in particular, in view of the many shortcomings that have afflicted it.
