التقاضي على درجتين في المادة الانتخابية كمقوم أساسي لتحقيق الأمن القضائي Two Levels Litigation In The Electoral Legislation As An Essential Component Of Achieving Judicial Security

Résumé: يعالج هذا المقال البحث في العلاقة القائمة بين تكريس التقاضي على درجتين في المادة الانتخابية ودوره في تجسيد الأمن القضائي، حيث أن هذا الأخير من المفاهيم الحديثة التي تحرص من خلاله معظم الدول على خلق بيئة ملائمة لعمل السلطة القضائية من خلال إرساء المزيد من الضمانات حفاظاً على الحقوق والحريات فردية كانت أو جماعية، تجسيداً بذلك لدولة الحق والقانون وعلى اعتبار أن الانتخابات هي الآلية الأساسية لتجسيد نظام حكم ديمقراطي، وهي الوسيلة المثلى لتمكين الشعب من اختيار من يحكم نيابة عنه، وإحدى أهم الحقوق السياسية الواجب حمايتها وصونها، كرس المشرع الانتخابي في الأمر 21_01 حق التقاضي على درجتين كأحد أهم الضمانات القانونية لإحقاق العدالة الانتخابية وأبرز دعائم تجسيد الأمن القضائي، وهو ما تحاول هذه الدراسة توضيحه من خلال تبيان مدى مساهمة تكريس التقاضي على درجتين في المادة الانتخابية في تحقيق الأمن القضائي. The present research paper revolves around the topic of the relationship between the dedication of litigation at two levels in the electoral material and its role in embodying judicial security, as the latter is considered as one of the modern concepts through which most countries are keen to create a suitable environment for the work of the judiciary by establishing more guarantees to preserve rights. On the same line of thought, freedoms, whether individual or collective, are an embodiment of the rule of law; considering that elections are the main mechanism for the embodiment of a democratic system of government, and it is the best way to enable the people to choose their governor, On this basis, one of the most important political rights that must be protected and preserved by the electoral legislature established in Order 21_01 is the right to litigation on two levels as one of the most important legal guarantees for achieving electoral justice and the most prominent pillars of embodying judicial security, The present study aims to clarify the extent to which the dedication of litigation on two levels in the electoral material contributes to achieving judicial security.
