آليات استرجاع المستحقات المالية لصندوق النفقة

Résumé: أحاط المشرع صندوق النفقة بجملة من الآليات لحمايته من خلال القانون رقم 15-01 المتضمن إنشاء صندوق النفقة حتى لا يتعرض إلى العجز والإفلاس، وهذه الآليات إما أن تكون آليات إدارية بواسطتها يمكن لأمين الخزينة الولائي اتخاذ مختلف الإجراءات الإدارية لاسترجاع أموال صندوق النفقة والمتمثلة في تحصيل المستحقات المالية من المدينين بالنفقة سواء عن طريق التحصيل الودي أو التحصيل الجبري، وإما أن تكون آليات قضائية من خلال متابعة الدائن بالنفقة بجريمة التصريح الكاذب، كما يجوز لأمين الخزينة الولائي متابعته مدنيا على أساس الإثراء غير المشروع ومطالبته بإرجاع المبالغ المالية التي تلقاها دون وجه حق، ويمكن أيضا أن تسلط عليه غرامة مالية.
