Résumé: ظهر التوقيع الالكتروني بظهور التجارة الالكترونية وذلك بالحاجة إلى وجود توقيع يتوافق مع طبيعتها، والتوقيع الالكتروني يختلف عن مفهوم التوقيع التقليدي، كما أنه يثير عدة مشاكل منها التعاقد الالكتروني، وإثبات بالمستند الالكتروني وصحتة. وعلى هذا الأساس سنتطرق للموضوع من خلال مبحثين: المبحث الأول خصصناه لدراسة خصوصيات التوقيع الالكتروني. وهذا بتبيان مفهومه وخصائصه ومميزاته وأنواعه. أما المبحث الثاني، فخصصناه لحجية التوقيع. الإلكتروني في الإثبات، بتبيان التصديق على التوقيع الإلكتروني وشروط صحته. وذلك من خلال الاستناد إلى القانون 04/15 المتعلق بالتوقيع والتصديق الالكترونيين. The electronic signature was demonstrated by the emergence of electronic commerce by the need for a signature compatible with its nature, an electronic signature different from the traditional signature concept, and raises, among other problems, electronic contracting, proof and a mere fact. On this basis, we will address the subject through two research papers: The first one we have devoted to the study of the specificities of an electronic signature. This is by demonstrating its concept, characteristics, characteristics and types. The second research, by indicating the ratification of the electronic signature and the terms of its validity, is devoted to the evidence of the electronic signature. This is based on Law 15-04 on electronic signature and authentication.
