أحكام فسخ عقد الامتياز الفلاحي في ظل القانون رقم 10/03

Résumé: يعتبر فسخ عقد الامتياز من أهم السلطات التي يتمتع بها الديوان للأراضي الفلاحية في مواجهة المستثمر صاحب الإمتياز، فهو من أهم الوسائل القانونية لإنهاء هذا العقد من دون الحاجة للجوء للقضاء كما قد ينتهي العقد من دون وقوع خطأ من المستثمر أو بطلب منه ،و عليه فإن أسباب فسخ عقد الامتياز الفلاحي متعددة باختلاف صور الفسخ و يمكن تصنيفها الى فسخ جزائي يطبق في حال اخلال المستثمر صاحب الامتياز بالتزاماته التعاقدية وفسخ تقديري قد يلجأ إليه لدواعي المصلحة العامة كما قد يتم بطلب من المستثمر صاحب الامتياز. The termination of the concession contract is considered one of the most important powers that the office has for agricultural lands in the face of the investor who owns the concession, as it is one of the most important legal means to terminate this contract without the need to resort to the judiciary, as the contract may end without an error from the investor or his request. The annulment of the agricultural concession contract has many different forms of termination and can be classified into a penal termination that is applied in the event that the investor who owns the concession breaches his contractual obligations and a discretionary termination that may be resorted to for reasons of public interest, as it may be at the request of the investor who owns the concession
