خصوصية الحماية القانونية من الشروط التعسفية في عقد الإستهلاك. Privacy Of Legal Protection From Arbitrary Terms In The Consumption Contract.

Résumé: يعد عقد الإستهلاك من عقود الإذعان التي تتسّم باختلال التوازن العقدي، والتي يقبل فيها المستهلك كطرف ضعيف كل ما ينفرد المتدخل أو المحترف كطرف قوي في العلاقة من شروط تعسفية دون أن يكون له الحق في مناقشتها بالرفض أو القبول وهو ما يعدّ اخلالا بفكرة التفاوض العقد كمقوّم أساسيي لمبدأ سلطان الإرادة في العقود الملزمة لجانبين ، وهو ما أدّى إلى تدخل المشرع في عقد الإستهلاك إعادة للتوازن العقدي وحماية للمستهلك من خلال آليات تشريعية تضمنتها القواعد العامة في القانون المدني والنصوص الخاصة بما فيها القانون الإطار 09-03 المتعلق بحماية المستهلك وقمع الغش وقانون الممارسات التجارية 04-02 والنصوص المطبقة لهما. الكلمات المفتاحية: Abstract: The consumer contract is one of the contracts of submission that are characterized by a contractual imbalance, in which the consumer accepts as a weak party all the arbitrary terms that the interfering party or the professional singles out as a strong party in the relationship without having the right to discuss them with rejection or acceptance, which is considered a violation of the idea of contract negotiation as a basic component. For the principle of will power in contracts binding on both sides, which led to the intervention of the legislator in the consumption contract to restore contractual balance and protect the consumer through legislative mechanisms included in the general rules of civil law and special texts, including Law Framework 09-03 related to consumer protection and the suppression of fraud and the Commercial Practices Law 04 -02 and the texts applied to them.
