Résumé: مقال معد للنشر، مقدم في فعاليات الملتقى الوطني الأول حول" الترجمة القانونية وتحديات العولمة" المنظم من طرف جامعة الجزائر، معهد الترجمة 02، في (6 ابريل 2021) ملخص: تعدٌ الترجمة القانونية للدستور من أصعب ميادين الترجمة المتخصصة، وتطرح هذه الدراسة إشكالية الصعوبات الدلالية المرتبطة بالمعاني المختلفة المترتبة على ترجمة القاعدة الدستورية من الفرنسية إلى العربية في دستور2020، حيث استهدفت تسليط الضوء على إشكالية المصطلح الدستوري، والتكافؤ في الترجمة، الذي يعد من أهم الصعوبات التي قد تواجه المترجم القانوني. وقد كشفت أن صعوبة ترجمة الدستور تكمن في كم المصطلحات الدستورية المستخدمة وتقنيتها واختلاف المنظومات القانونية للنصوص الأصلية و المترجمة، وفي عدم تمكن القائم بها من إعطاء المعنى الدلالي المقصود من السلطة التأسيسية، نظرا لعدم امتلاكه الدراية المتعمقة بهذا العلم، وعدم إدراك خبايا الأنظمة القانونية، كما أثبتت عدم الاستعانة في ترجمة الدستور، بالمتخصصين في الترجمة الحائزين على تدريب أكاديمي، وخرجت بعدة توصيات أهمها؛ ضرورة اعتماد القواعد التقنية المتعلقة بالصياغة القانونية للدستور من ناحية وترجمته وفقا لجوهره، بالتركيز على حرفية النص لترجمة المصطلحات الدستورية التقنية، مع الاستعانة في بعض الأحيان بالترجمة المكافئة في هذا الخصوص لعدم الخروج على مقصود المؤسس الدستوري. Abstract Legal translation of the constitution is one of the most difficult fields of specialized translation, and this study raises the problem of semantic difficulties associated with the different meanings resulting from translating the constitutional rule from French into Arabic in the 2020 constitution. You may encounter legal translator. It revealed that the difficulty of translating the constitution lies in the amount of constitutional terminology used and its technique, and the different legal systems of the original and translated texts, and in the inability of the author to give the semantic meaning intended by the constituent authority, due to his lack of in-depth knowledge of this science, and his lack of awareness of the mysteries of legal systems. It demonstrated the lack of assistance in translating the constitution, with translation specialists with academic training, and came up with several recommendations, the most important of which are; The necessity of adopting the technical rules related to the legal drafting of the constitution on the one hand and translating it according to its essence, focusing on the literalness of the text in order to translate technical constitutional terms, with sometimes the use of equivalent translation in this regard in order not to deviate from the intention of the constitutional founder.
