Résumé: نظرا إلى تزايد التنافس على الاستثمارات الأجنبية أصبحت الدول تعطي أهمية بالغة لمسألة إبرام عقود الاستثمار . لكن من جانب آخر فإن المستثمر يحتاج إلى ضمانات وحوافز لتوفير مناخ ملائم للاستثمار، ومن بين هذه الضمانات عدم إحالة النزاعات الناشئة عن عقود الاستثمار على قضاء الدولة المضيفة، مما جعل الكثير من الدول تسعى إلى إيجاد حلول بديلة لفض تلك المنازعات والتي تتسم بخصوصية مميزة، وكان التحكيم هو البديل الأنسب لذلك . Abstract: In view of increasing competition for foreign investment, States are placing great importance on the issue of entering into investment contracts . But on the other hand, the investor needs guarantees and incentives to provide a favorable environment for investment, among these guarantees not to refer disputes arising from investment contracts to the jurisdiction of the host country, which has made many countries seek alternative solutions to settle such disputes, which are characterized by a distinctive peculiarity, and arbitration was the most suitable alternative to this
