تطور نظام التعويض من دين على عاتق المسؤول إلى حق للمضرور

Résumé: ملخص: تناول المشرع الجزائري أحكام التعويض من خلال نظامين مختلفين، نظام المسؤولية المدنية ونظام التعويض في التشريعات الخاصة، والتعويض في القانون المدني هو دائما علاقة دائنية ما بين المضرور والمسؤول، وإذا أراد الضحية الحصول على التعويض فلابد من رفع دعوى قضائية أمام القضاء المختص، ويتمتع القاضي بسلطة تقديرية مطلقة فيما يخص تقدير التعويض، ويشمل كل الأضرار مهما كانت طبيعتها تكريسا لمبدأ التعويض الكامل للأضرار، بينما التعويض في التشريعات الخاصة هو حق للمضرور فلا توجد أي علاقة مباشرة أو غير مباشرة ما بين الضحية والمسؤول، وأصبحت العلاقة الجديدة ما بين المضرور وشركة التأمين أو صناديق الضمان، والمدين بالتعويض يعتبر ضامن وليس مسؤول عن الضرر وعليه يكون التعويض جزافي لا يغطي كل الأضرار. Abstract: The Algerian legislature discussed the provisions of compensation through two different systems, civil liability and compensation in private legislation, and compensation in civil law is always a creditor relationship between the injured and the responsible, and if the victim wants to obtain compensation, a judicial lawsuit must be brought before the competent court. The judge has absolute discretion in assessing compensation, including all damages of any nature in respect of the principle of full compensation for damages, whereas compensation in private legislation is a right of the injured, there is no direct or indirect relationship between the victim and the responsible, and the new relationship has become harmful, the insurance company or the guarantee funds.
