واقع الصيرفة الإسلامية في الجزائر في ظل القانون النقدي والمصرفي 23-09 The Impact Of Freedom Of Competition On Consumer Rights In The Banking Field

Résumé: تهدف هذه الورقة البحثية إلى دراسة واقع الصيرفة الإسلامية في الجزائر، من خلال معرفة تطور الصيرفة الإسلامية في المنظومة البنكية الجزائرية وعرض النصوص القانونية التي تنظمها، وكذا إبراز الصعوبات التي كانت تعترضها والتي حاول المشرع تدارك معظمها قصد تطوير وتسهيل انتشار التمويل الإسلامي. وخلصت الدراسة إلى أن الصيرفة الإسلامية محدودة الإنتشار، وبصدور القانون النقدي والمصرفي رقم 23-09 يتوقع انتشار نشاط الصيرفة الإسلامية في الجزائر في السنوات القليلة القادمة، لوجود نية وإرادة سياسية لتنظيم وتأطير ممارسة العمليات البنكية وفق أسس ومبادئ الشريعة الإسلامية. This research paper aims to study the reality of Islamic banking in Algeria, by knowing the development of Islamic banking in the Algerian banking system and presenting the legal texts that regulate it, as well as highlighting the difficulties encountered, most of which the legislator tried to remedy in order to develop and facilitate the spread of Islamic finance. The study concluded that Islamic banking is limited in its spread, and with the issuance of Monetary and Banking Law No. 23-09, Islamic banking activity is expected to spread in Algeria in the next few years, due to the presence of intention and political will to organize and frame the practice of banking operations in accordance with the foundations and principles of Islamic Sharia.
