Résumé: ملخص المقالة يقوم عقد العمل على نوع من الموازنة التي تضمن حقوق العامل من جهة وحقوق المستخدم من جهة أخرى، وعلى ذلك أصدر المشرع الجزائري نصوصا خاصة ببعض الفئات العمالية بالنظر لطبيعة عملها. ومما لاشك فيه أن عقد العمل البحري تبرز فيه مظاهر الضعف بالنسبة للأجير وهو مستخدم الملاحة البحرية، الأمر الذي يحتم وجود نصوص تكرس الحماية لهذا الطرف إن على مستوى قيام العقد في حد ذاته أو على مستوى تنفيذه مما يكفل تقليصا لتلك الهوة وإضفاء مزيد للحماية للأجير. وسنحاول في هذه الورقة البحثية تجلية مظاهر حماية العامل البحري.

Article summary The labor contract is based on a kind of balance that guarantees the rights of the worker on one hand and the rights of the employer on the other hand. According to the Algerian legislation issued texts specific to certain categories of workers related to their work nature. There is no doubt that the contract of maritime work contains some weakness points on the level of maritime navigation employer

which necessitates the existence of texts dedicated to the protection of this category at the level of the contract itself or at the level of its execution

which will reduce that gap and provides more protection to the employee . In this paper

we will attempt to demonstrate the aspects of maritime worker protection .
