Résumé: تتناول هذه الصفحات بالدراسة أثر الأعراف والعوائد في تغير الأحكام والفتاوى؛ حيث إن الناس لا غنى لهم عن عوائدهم وأعرافهم في تسيير شؤون معاشهم، وجاءت الشريعة الإسلامية لتحصيل المصالح وتكميلها من خلال منظومة الأحكام التي تراعي مختلف الأوضاع والأحوال؛ وعلى هذا نلاحظ تغير كثير من الأحكام والفتاوى بما يراعي الأعراف والمصالح. وسوف نحاول تتبع أهم مفردات هذا الموضوع من خلال بحث النقاط التالية: تحديد المفاهيم: العرف والعادة والفتوى وتغيرها، وبيان قابلية الأعراف والعوائد للتغير من عدمه، وعرض حجية العرف، وأخيرا توضيح تغير الأحكام والفتاوى بتغير الأعراف والعوائد. Abstract: This paper deals with the impact of the usages and habits change in Judgments and advisory opinions; so that people can not do without their habits and usages in the conduct of the affairs of their livelihood. Islamic law (Charia) aimed to collect the interests and supplemented through the system provisions that take into account the different situations and conditions. Therefore, we note change many of the judgments and opinions that take into account the usages and interests.
