Résumé: يعتبر انحلال الزواج المختلط من أهم مسائل الأحوال الشخصية وأفسحها مجالا لتنازع القوانين، نظرا للاعتبارات الاجتماعية، والدينية والخلقية التي يقوم عليها الزواج، ونظرا لاختلاف نظرة المجتمع إليه إن اختلاف الدول في نظرتها إلى انحلال الرابطة الزوجية أدى إلى اختلاف القوانين في تحديد قواعد الإسناد التي تحكمه، فقد أسندت بعض الدول انحلال الزواج إلى قانون جنسية الزوج وقت رفع الدعوى في حين فرّقت التشريعات العربية الأخرى بين الطلاق بالإرادة المنفردة للزوج والتطليق والانفصال الجسماني، وأخضعته دول أخرى إلى قانون الجنسية المشتركة للزوجين وقت رفع الدعوى، وفي حالة الاختلاف في الجنسية يطبق قانون الموطن المشترك، وإلا فقانون القاضي.
