المسألة الدستورية الأولية والمجلس الدستوري الفرنسي

Résumé: الدفع بعدم الدستورية، الذي سماه المشرع العضوي الفرنسي بالمسألة الدستورية الأولية أو المسألة الدستورية ذات الأولوية ( Q.P.C)، سيقوي من الطبيعة القضائية للمجلس الدستوري الفرنسي، لكنه لن يحوله إلى محكمة دستورية بسبب بعض الإكراهات التاريخية للنظام القانوني الفرنسي. رغم إلحاح الفقه الدستوري الفرنسي على المؤسس الدستوري لتسميته بالمحكمة الدستورية، ورغم تغير الإجراءات أمام المجلس الدستوري بمناسبة المسألة الدستورية ذات الأولوية، فالمجلس الدستوري الفرنسي بقى هيئة دستورية سياسية، ذات اختصاص قضائي. وستسلط هذه الورقة البحثية الضوء على تأثير المسألة الدستورية الأولية على طبيعة المجلس الدستوري الفرنسي.
