Résumé: لقد تناولنا من خلال هذه الدراسة مفهوم الغش في عقد استغلال براءة الاختراع وذلك نظرا لأهمية هذا الموضوع و الذي شغل الباحثين القانونيين و لقي اهتمامهم من الفقه والقضاء و المحامين وغيرهم من رجال القانون و هو ما جعلنا نقسم هذه الدراسة إلى عنصرين أساسيين أولهما تناولنا فيه ماهية الغش في النظام القانوني لبراءة الاخــــــــتراع و الثاني عالجنا فيه الحماية القانونية لبراءة الاختراع من الغش و ذلك للوقوف على أهم التغيرات و التطورات القانونية المساعدة على حماية الاختراعات وأصحابها على حد سواء و إسقاط جملة من الأحكام العامة على خصوصية عقد ترخيص استغلال براءة الاختراع حتى يمكننا معرفة أهم الاستراتيجيات التي من خلالها يتم حفظ مصالح أطراف عقد استغلال براءة الاختراع. Abstract Through this study, we dealt with the concept of fraud in the contract exploiting the patent, due to the importance of this topic, which occupied legal researchers and received their attention from jurisprudence, so the judiciary, lawyers, and others legal made, division to this study and divided into two basic elements. They dealt with the nature of fraud in the patent system, and the second dealt with the legal protection of the patent from fraud, in order to identify the most important changes and legal developments, that help protect inventions and their owners alike and to drop a set of general provisions on the privacy of the contract. This invention shows us the most important strategies, by which the .interests of the parties to the contract are exploited
