ضوابط الترخيص الاجباري لبراءات الاختراع

Résumé: الملخص: يخضع الترخيص الإجباري باستغلال براءة الاختراع بسبب نقص أو عدم استغلال براءة الاختراع من صاحب البراءة لنظام قانوني خاص به، وضعت قواعده كل من الاتفاقيات الدولية والتشريعات الوطنية من بينها القانون الجزائري لبراءات الاختراع ،بحيث يبدو جليا من تنظيم القانون لأحكام هذا العقد تغليب المصلحة العامة للمجتمع ولضمان انتفاع الجميع من الاختراعات الحديثة وتحقيق التنمية الاقتصادية في مختلف الميادين Abstract: The compulsory license to exploit the patent due to the lack or non-exploitation of the patent by the patent owner is subject to his own legal system. Its rules are laid down by both international agreements and national legislation, including the Algerian patent law ,So that it seems that the law will regulate the provisions of this contract to give priority to the public interest of society and to ensure that everyone benefits from modern inventions and to achieve economic development in various fields.
