Résumé: تعتبر العقود الالكترونية عبر الانترنت من أهم المشكلات المعاصرة، فمع التطور التكنولوجي أصبح المستهلك ضحية الدعايات التي تصاحب عرض السلع و الخدمات، الشيء الذي يؤثر بشكل واسع على توجيهه مما يجعله يقع في غلط يضر بمصلحته، أو قد يمس بخصوصياته. لهذا فقد صدرت في سبيل توفير ضمانات للمستهلك المتعاقد عبر الانترنت عدة قوانين وطنية ودولية، الى جانب توجيهات محلية، هذا كله من أجل تعزيز الحماية القانونية لهذا المستهلك من جهة، وتشجيعا للتجارة الالكترونية من جهة أخرى. With the advancement of technology, consumer has become a victim of the propaganda that accompanies the supply of goods and services, which greatly affects its orientation that harms its interests or may compromise its privacy. Therefore, several national and international laws have been promulgated in order to provide guarantees to the contracted consumer online along with local directives. In order to enhance the legal protection of the consumer ;on the one hand and to encourage e-commerce on the other.
