السلطة العليا للشفافية والوقاية من الفساد ومكافحته بمنظور القانون 22-08

Résumé: نتناول في هذه الدراسة السلطة العليا للشفافية والوقاية من الفساد ومكافحته، وذلك بتسليط الضوء على التوجه الجديد الدي حمله القانون رقم 22-08 بخصوص سير وأداء هذه السلطة. محاولين التطرق ومعالجة مختلف الجوانب المتعلقة بها، وهذا بتحليل وقراءة مواد ذات القانون. توصلنا إلى أن الرؤية القانونية لهذه السلطة بموجب القانون رقم 22-08، تضعها في خانة الهيئات الإدارية المستقلة، ومانحة لها أدوار خاصة تتناسب وخصوصية مركزها في سبيل تحقيق أعلى مؤشرات النزاهة والشفافية في تسيير الشؤون العمومية، وتباينت تلك الأدوار بين البعد الوقائي والبعد العلاجي أو الردعي. وتعد هذه الأدوار الأخيرة سمة بارزة في التوجه الجديد المكرس بمقتضى القانون 22-08 القاضي إلى مكافحة الفساد. In this study, we address the supreme authority for transparency and prevention and control of corruption, by highlighting the new trend brought by Law No. 22-08 regarding the functioning and performance of this authority. Trying to address and address the various aspects .related to it, by analyzing and reading the articles of the law We concluded that the legal vision of this authority under Law No. 22-08 places it in the category of independent administrative bodies, granting them special roles commensurate with the specificity of their position in varied order to achieve the highest indicators of integrity and transparency in the conduct of public affairs, and these roles between the preventive dimension and the remedial or deterrent dimension .These latter roles are a prominent feature of the new approach enshrined in Law 22-08, which aims to combat corruption
