قراءة في تحول المؤسس الدستوري الجزائري من المجلس الدستوري الى المحكمة الدستورية في ظل التعديل الدستوري 2020.

Résumé: استحدث المؤسس الدستوري الجزائري في التعديل الدستوري سنة 2020 مؤسسة دستورية رقابية مستقلة بديلة عن المجلس الدستوري، واوكل لها مهمة ضمان احترام الدستور وضبط سير المؤسسات الدستورية ونشاط السلطات العمومية، سميت بالمحكمة الدستورية ، كما انه وسع من صلاحياتها مقارنة بالمجلس الدستوري سابقا رغم احتفاظه بالكثير من الاختصاصات والتي نقلها الى الهيئة المستحدثة سواء كانت من الجوانب الشكلية او الوظيفية. و أضاف جملة من التغيرات في اطار تحوله من المجلس الدستوري الى المحكمة الدستورية شملت طبيعة الرقابة الدستورية حيث أوكل للمحكمة الدستورية اختصاصا جديدا تمثل في سلطة الفصل في الخلافات القائمة بين السلطات الدستورية وتفسير الاحكام الدستورية ،كما فعل آلية الدفع بعدم الدستورية لتمتد الى النصوص التنظيمية وفي الوقت ذاته عمل على التركيز على الاختصاص القانوني لأعضاء المحكمة الدستورية Abstract: Currently , in the constitutional amendment of 2020; the Algerian constitutional institution created an independent, oversight constitutional institution as an alternative to the Constitutional Council, and entrusted it with the task of ensuring respect for the constitution and controlling the functioning of constitutional institutions and the activity of public authorities. Which is transferred to the newly created body, whether it was from the formal or functional aspects. Practically , it was added a number of changes in the framework of its transformation from the Constitutional Council to the Constitutional Court, including the nature of constitutional oversight, as it is entrusted the Constitutional Court with a new jurisdiction represented in the power to adjudicate existing disputes between the constitutional authorities and the interpretation of constitutional provisions. Initially working to focus on the legal jurisdiction of members of the Constitutional Court.
