Résumé: عمد المشرع الجزائري تكييف منظومته التشريعية مع واقع التجارة الإلكترونية حيث صدر أول قانون بنظم المعاملات التجارية الإلكترونية في 10 ماي 2018 ، و قد نظم القانون عقد الاستهلاك الإلكتروني ببيان أطرافه و الالتزامات المترتبة عليه، حيث ركزنا من خلال هذا البحث على الالتزام بتسليم منتوج أو أداء خدمة مطابقة،-و هو من الالتزامات المكرسة في إطار قانون حماية المستهلك -ببيان وجه الخصوصية لهذا الالتزام في ظل قانون حماية التجارة الإلكترونية، ومن النتائج المتوصل إليها تداخل مفهوم الالتزام بالمطابقة مع الالتزامات الموضوعية الأخرى مثل الالتزام بالتسليم و الالتزام بالإعلام هذا مع ضرورة ضبط مفهوم الالتزام ليشمل جميع المراحل من الإنتاج إلى العرض والاستهلاك. The Algerian legislator deliberately adapted his legislative system to the reality of electronic commerce, as the first law regulating electronic commercial transactions was issued on 10 May 2018,The law organized the electronic consumption contract by stating its parties and the obligations arising from it . Where we focused through this research on the commitment to deliver an identical product or perform a matching service,which is one of the obligations enshrined in consumer protection Law-explaining the privacy of this obligation in the framework of the electronic commerce law, Among the results obtained we note the overlap of the concept of this obligation with other objective obligations such as the commitment of mark and the commitment to delivery, with the need to adjust the concept of commitment to include all stages of production presentation and consumption. .
