المشاركة السياسية للمرأة الجزائرية في ظل القانون العضوي رقم: 03/12 (التمثيل في المجالس المنتخبة نموذجا)

Résumé: ساهمت المنظومة القانونية الدولية في مجال حماية حقوق المرأة في دفع الدول إلى إقرار مبدأ المساواة بين الرجل والمرأة في ممارسة الحقوق السياسية، وهو التوجه الذي أخذت به الجزائر بعد إنضمامها لمختلف الإتفاقيات الدولية ذات الصلة بحقوق المرأة، لاسيّما بعد التعديل الدستوري لسنة 2008 بإضافة المادة 31 مكرر وإصدار القانون العضوي رقم: 03/12 الذي يحدد كيفيات توسيع حظوظ تمثيل المرأة في المجالس المنتخبة، ولقد أثبتت التجربة الجزائرية بعد تطبيق نظام الحصة النسائية إرتفاع نسبة تمثيل المرأة في المجالس المنتخبة وإزالة العقبات التي تحول دون مشاركة الجميع الفعلية في الحياة السياسية دون تمييز بين الفئات بالنظر لمبدأ المساواة المكرس دستوريًا، غير أن تحقيق الفاعلية في التمثيل تقتضي ضرورة مواصلة الجهود والإصلاحات قصد تعزيز التمكين السياسي للمرأة. The international legal system has contributed to the protection of women's right to advancing states to uphold the principle of equality betwen men and women in the exercice of political rights, it is attitude that Algeria has taken after its accession to various international conventions relating to women's rights, this is especially after constitutional amendment of 2008 by adding article 31 bis and the promulgation of organic law N°:12/03 this defines to expand the chances of women being represented on elected assemblies, The Algerian experience has been demonstrated after application of system women's quota the high percentage representation women's on elected assemblies, and to remove the obstacles that prevent effective participation of all in political life, without distinction betewen categories in view of the principle of equality constitutionally enshrined, However, effective representation requires continued efforts and reforms to promote the political empowerment of women.
