التعاون الدولي لاسترداد العائدات المتحصلة من جرائم الفساد International Cooperation To Recover Proceeds From Corruption Crimes

Résumé: غالبا ما يقوم الموظف الفاسد الذي يتربح من وظيفته بإخفاء جريمته عبر تهريب عائدات الجريمة للخارج، وهو أمر خطير لما ينطوي عليه من المساس بالاقتصاد الوطني، إذ تخسر الدولة عائدات تملكها في الأصل مما يكبد اقتصادها خسائر وخيمة ويعرقل التنمية فيها، لذلك فقد أجمعت الاتفاقيات الدولية على ضرورة تضافر الجهود الدولية في سبيل تمكين الدولة المهربة أموالها من استعادتها، فقد أوردت اتفاقية الأمم المتحدة لمكافحة الفساد لسنة 2003 الأحكام الشاملة بخصوص استرداد الموجودات، وأقرّت آليات ووسائل متعددة في سبيل استردادها. إن تجريم أشكال الفساد وفرض إجراءات خاصة على البنوك بشأن التبليغ غير كافيين للقضاء عليه، لذلك كان لا بد من تكريس مبدأ التعاون الدولي لاسترداد العائدات المتحصلة من جرائم الفساد والذي يتم عن طريق التحفظ على هذه الأموال، ومصادرتها والمساعدة القضائية المتبادلة قصد ضمان استرداد الدولة لعائداتها، إلا أن عملية الاسترداد غالبا ما تتصف بالتعقيد وطول الإجراءات، كما وأن اختلاف القوانين بين الدولة التي هربت منها الأموال والدولة التي وصلت إليها يؤدي غالبا إلى عراقيل كثيرة قد تتسبب في عدم استرجاع الدولة لجزء كبير من أموالها المسلوبة. وعلى الجزائر بصفتها دولة قد ثبت تهريب أموال طائلة من خزينتها للخارج، الاستفادة من خبرات الدول التي سبقتها في هذا المجال، مع تفعيل التعاون الدولي والإجرائي لاسترداد جزء من أموالها المهربة. The corrupt official often takes advantage of his function to conceal his offense by transferring the proceeds of his criminal activity abroad, which constitutes a real danger for the national economy because the state loses revenues and this hampers its development. As a result, international conventions are unanimous on the need to help the State whose funds have been diverted to recover them. The provisions of the 2003 United Nations Convention against Corruption established mechanisms and means for recovering these revenues. The criminalization of the various forms of corruption and the procedures imposed on the banks concerning the denunciation of the offenses are insufficient to eradicate this crime. That is why cooperation between States, in the form of mutual legal assistance, through, inter alia, confiscation, seizure or freezing of the proceeds of crime is paramount. Unfortunately, the recovery of capital is often difficult because the procedures are long and complicated. In addition, the dissimilarity of laws between states is an additional obstacle which often prevents the recovery of looted property. Algeria, considered as a state where this form of diversion has been established, must draw on the experiences of other states in the implementation of international and procedural cooperation to recover this misappropriated capital.
